The journal you create belongs to you. Our role is simply to provide the tools that allow you to securely capture, organize, and revisit the beverages and experiences that matter to you.
SipMarked is intended exclusively for individuals who are of legal drinking age in their country or jurisdiction.

Subscription features may evolve as SipMarked introduces new capabilities.
Paid subscriptions automatically renew unless cancelled before the end of the current billing period.
You authorize us (or the applicable App Store) to charge your selected payment method for each renewal period.
We will notify you before any material pricing changes take effect.
Subscriptions purchased through the Apple App Store or Google Play Store are subject to the billing, renewal, cancellation, and refund policies of those platforms.
Subscriptions purchased directly through SipMarked are processed securely through our payment provider.
SipMarked does not store your full payment card information.
You may cancel your subscription at any time.
Cancellation takes effect at the end of the current subscription period, and your paid features remain available until that time.
Subscription fees are non-refundable except where required by applicable law.

The Free plan is supported by advertising provided through third-party advertising partners.
Advertising is designed to be limited and non-intrusive.
By using the Free tier, you consent to receiving advertisements as described in our Privacy Policy.
"User Content" includes photographs, tasting notes, ratings, journal entries, and any other content you create within SipMarked.
You retain all ownership rights in your User Content.
By using SipMarked, you grant us a limited, worldwide, royalty-free licence to store, process, synchronize, back up, and display your User Content solely as necessary to provide the SipMarked service.
We do not claim ownership of your journal.
You are responsible for ensuring your content:
SipMarked uses artificial intelligence to assist with selected features, including:
AI-generated content is intended only as a starting point.
Published editorial content is reviewed by a human before being made available within the Service.
User Content submitted for AI features is processed only to provide the requested functionality.
SipMarked does not use your personal journal content or uploaded photographs to train generative AI models.
SipMarked is designed to help users appreciate and remember beverages responsibly.
Nothing within the Service encourages excessive or irresponsible alcohol consumption.

Violation of these Terms may result in suspension or termination of your account.
From time to time SipMarked may make preview or beta features available.
Beta features are provided "as is," may change or be discontinued at any time, and may not perform as reliably as production features.
The SipMarked name, branding, logos, software, designs, graphics, and all original content (excluding User Content) are the exclusive property of SipMarked LLC and are protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms transfers ownership of any SipMarked intellectual property to you.
SipMarked relies on trusted third-party providers for services including:

SipMarked is not responsible for the practices of independent third-party providers.
We continually improve SipMarked.
Accordingly, we may add, modify, suspend, or discontinue features at any time.

To the fullest extent permitted by law, SipMarked is provided "as is" and "as available."
We do not guarantee that the Service will always be uninterrupted, error-free, or free from defects.
Information within SipMarked is intended for personal enjoyment and record-keeping and should not be considered medical, financial, legal, or professional advice.
Nothing in these Terms limits any consumer rights that cannot legally be excluded.
To the fullest extent permitted by law, SipMarked LLC and its officers, employees, contractors, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim shall not exceed the greater of:
Some jurisdictions do not permit certain liability limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
We may create anonymous, aggregated statistics derived from usage of the Service, such as the most-logged wine regions or grape varieties.

You may delete your account at any time through the app (where available) or by contacting support@sipmarked.com.
Upon deletion, your personal information will be handled in accordance with our Privacy Policy.
We may suspend or terminate accounts that violate these Terms or where required by law.
If SipMarked terminates a paid subscription for reasons unrelated to your conduct, we will provide any refund required by applicable law.
SipMarked may assign or transfer these Terms as part of a merger, acquisition, financing, restructuring, or sale of assets.
Your continued use of the Service following such a transaction constitutes acceptance of the transfer.
SipMarked is not responsible for delays or failures caused by events beyond our reasonable control, including internet outages, cloud service interruptions, natural disasters, government actions, labour disputes, or cyber attacks.
You agree not to use SipMarked in violation of applicable export control, sanctions, or trade laws.
We may revise these Terms from time to time.
Where required, we will notify users of material changes by email or through the app before the revised Terms become effective.
Your continued use of SipMarked after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts.
Before initiating legal proceedings, both parties agree to attempt to resolve disputes informally by contacting support@sipmarked.com.
If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in Boston, Massachusetts, under the American Arbitration Association Consumer Arbitration Rules, except where either party may bring an eligible claim in small claims court.
These Terms are governed by the laws of England and Wales.
Nothing in these Terms limits any mandatory consumer rights available under applicable law.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SipMarked regarding the Service.
If any provision is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce any right shall not constitute a waiver of that right.
